1. Introduction
These Terms of Use govern your access to and use of the Inkforms web application and services. Inkforms is a secure, web-based platform that enables service providers to collect client information digitally and streamline their form workflows. The platform offers customizable form links, automated PDF generation, and delivery to the email address specified by the service provider. It is used across a wide range of industries including wellness, beauty, fitness, events, and more. Upon completion, the application generates a PDF file with the submitted data and delivers it directly to the designated email address. These forms are accessed through personalized subdomains (e.g., yourbusiness.inkforms.app), which are included in the service subscription but remain the property of Inkforms. Inkforms is an independent service and is not affiliated with, owned by, or operated on behalf of any studio, business, or third-party company. While we make every effort to maintain continuous availability, service interruptions may occasionally occur due to maintenance or external factors.
2. Disclaimer of Liability
Inkforms is not involved in, nor liable for, any disputes, complaints, or dissatisfaction that may arise between clients and service providers using the platform. Our role is strictly limited to providing the technical infrastructure for generating and transmitting PDF documents. We do not participate in, nor do we review, the negotiation, delivery, or quality of services rendered by the service provider. The service provider alone is responsible for the accuracy and legality of the data submitted via the forms. Inkforms assumes no responsibility for any content transmitted through the platform or for services delivered based on that content.
3. Privacy and Information Use
Inkforms operates primarily as a data processor, facilitating the transmission of information between clients and service providers. However, to ensure service quality and allow for technical support and debugging, Inkforms logs certain metadata related to each submission, beign these the following:

The only personally identifiable information retained in these logs is the email address of the recipients, which is used exclusively for debugging in case of errors or failed deliveries. These logs are never used for marketing purposes and are not shared with third parties. Inkforms does not retain the contents of submitted forms or any generated PDFs after delivery. If a client wishes to retrieve a previously submitted form, they must contact the service provider directly. Service providers are solely responsible for how they store, protect, and use the client data they receive. If they choose to use client information for commercial or promotional purposes, they must ensure compliance with applicable data protection laws. Inkforms is not responsible for any such use.
4. Third-Party Services
Inkforms relies on reputable third-party services to deliver essential features and maintain platform stability:

Inkforms infrastructure may be hosted in, but is not limited to, the following data center locations:

These hosting locations are selected to ensure global performance and redundancy, but availability may vary based on service regions and infrastructure providers. By using Inkforms, you acknowledge that these third-party services are governed by their respective terms and privacy policies, over which Inkforms has no control. While we take all reasonable measures to ensure the availability, reliability, and security of these services, Inkforms cannot be held liable for service interruptions, data access issues, or other disruptions caused by these external providers.
5. Changes and Jurisdiction
Inkforms reserves the right to update or modify these Terms of Use at any time. Updates will take effect immediately upon being published within the application. A link to the current Terms of Use is included in all relevant communication and is always available at www.inkforms.app. By continuing to use Inkforms after changes have been made, you accept the revised Terms. These Terms are governed by the laws of Switzerland. Any disputes arising from or in connection with this agreement shall fall under the exclusive jurisdiction of the courts of Zürich, Switzerland.
6. Termination
Inkforms reserves the right to terminate or suspend your account and access to its services at its sole discretion, without prior notice, for conduct that it believes violates these Terms, is harmful to other users, Inkforms, or third parties, or for any other reason. In the event of such termination, your right to use the services will immediately cease. Furthermore, failure to remit the subscription fee as stipulated by Inkforms will result in the deactivation of the active form associated with the client.
